HIRER & DRIVER'S LIABILITY

 

The driver and hirer are bound by all the terms & conditions of this hire agreement.

In signing the hire form the hirer is agreeing to these terms & conditions of hire.

 

DOCUMENTATION REQUIRED AND DRIVER ELIGIBILITY

 

New legislation from June 2015 states that hire companies must now log on to the DVLA website to check the online list of all drivers' offences. All drivers need to generate a code from the DVLA website that is only valid for 21 days. Valid codes need to be presented at the commencement of the hire in order to validate your insurance.

 

A current, valid driving licence must be produced at the start of every hire for every driver.

Drivers must be between 25 and 70 years of age and have held their licence for at least two years.

Gigwheels Ltd reserves the right to scan and to privately hold electronic copies of the driver's documents for Gigwheels Ltd administrative purposes only

 

Holders of non-UK driving licences must forward a copy of the licence to Gigwheels Ltd at least one week prior to the start of the hire in order for Gigwheels Ltd to arrange suitable insurance cover - this may involve a surcharge to be levied from the insurers.

 

Gigwheels Ltd will not allow drivers if any of the following apply:-

 

The driver has been convicted of driving under the influence of alcohol or drugs - unless the licence has been reinstated for a period of no less than 5 years.

The driver has had insurance declined or a policy cancelled by an insurer - unless by prior arrangement

The driver is employed or is engaged in a racing sport

The driver has been involved in more than one road traffic accident in the last 3 years

The driver has less than two years driving experience in the U.K.

 

All drivers must be deemed medically fit enough to drive and are obliged to disclose any pre-existing condition that might impair their driving abilities.

 

All U.K residents, in addition to their driving licence, must produce a utility bill or bank statement dated within the last 3 months and a valid debit or credit card at the time of the hire. Non-UK hirers must be able to produce a passport and valid credit card in the name of the main hirer.

 

All additional drivers must be present at the time of hiring and produce their driving licences and codes from the DVLA website

 

PAYMENT METHODS  & CANCELLATIONS

 

Hirers are required to pay 50% of the total hire cost in order to confirm and secure their booking. Bookings with Gigwheels Ltd are not confirmed until this payment is received. Once received, the 50% securing deposit is non-refundable. Should the hirer wish to cancel the hire at any point after confirming, the 50% deposit is taken as a cancellation fee.

 

Full payment has to be received by Gigwheels Ltd prior to the start of the hire period.

 

All hires are subject to the payment of a refundable damage deposit to cover damages and parking/traffic violations. For one day hires this figure is £300, for longer hires this figure is £500. This deposit is fully refundable upon safe return of the vehicle with no outstanding fines and will be returned to the hirer by Gigwheels Ltd, in the same manner in which it was paid.

 

Acceptable payment methods are BACS transfers & cash. Cheques are no longer acceptable as of 25th June 2015.

 

INSURANCE

 

Third party insurance is included in the hire charge. The policy has an excess of £600.

The hirer agrees that they are liable to pay the excess in the event of damage to Gigwheels Ltd's vehicle and/or third party vehicle[s].

The hirer agrees that liability is to be decided at the sole discretion of Gigwheels Ltd's insurer.

 

In the event of an accident the hirer agrees to:-

- Obtain the names and addresses of all parties involved  

- Not admit liability or guilt or give money to any persons involved.

- Notify the police immediately if liability has be ascertained or if anyone is injured.

- Contact Gigwheels Ltd by telephone immediately and assist with the accident report

 

Our insurance policy will not cover theft or damage to the hirer's personal belongings. All items left in the vehicle are left there at the hirer's own risk.

 

Only the driver[s] named at the beginning of the hire will be insured to drive the vehicle - under no circumstances can anyone else drive the vehicle during the hire period

 

EUROPEAN TRAVEL & EXCESSIVE MILEAGE POLICY

 

All European travel must be pre-approved by Gigwheels Ltd.

 

All hirer's taking vehicles out of the U.K must provide Gigwheels Ltd with a tour itinerary prior to departure.

Gigwheels Ltd may refuse permission for vehicles to be taken to certain non-EU countries

 

All hirer's must take out their own European Breakdown cover. This cover must include clauses that guarantee the return of the vehicle to the UK. Gigwheels Ltd will not allow hires to Europe to commence without the hirer providing evidence that this cover is in place and with a recognised company - i.e. the RAC or the AA.

 

Hires that exceed 3000 miles in any 28 day time period are subject to an excessive mileage charge of 10 pence per mile over 3000 miles [as of 20/06/2015]

 

 

PARKING FINES, TARIFFS AND MOTORING OFFENCES

 

The hirer is responsible for all speeding, parking and congestion charge fines and fees.

 

When a Notice To Owner is received, Gigwheels Ltd will forward copies of the hire agreement / terms and conditions and driving licence scan to the relevant council or organisation in order to prove that the vehicle was under hire.

 

Gigwheels Ltd will charge £40 administration costs for each contravention handled that Gigwheels Ltd was not made aware of by the hirer at the end of the hire.

 

Gigwheels Ltd reserves the right to retain some or all of the hirer's refundable deposit at the end of the hire in order to cover any administration costs incurred after the hire by undeclared fines and parking tickets. If Gigwheels Ltd does hold onto some/all of the deposit, this will be for a period of time no longer than 21 days from the end date of the hire.

 

If the hirer commits any offence that causes the vehicle to be impounded, Gigwheels Ltd will charge the hirer at the daily hire rate for each day the vehicle is held and for any damages caused to the vehicle during this time.

 

The hirer must not carry a number of persons and equipment which would cause the vehicle to be overloaded. The current gross permissible weight is 3.5 tonnes.

 

The hirer must not tow any trailers with the vehicle without the prior explicit consent of Gigwheels Ltd.

 

BREAKDOWN RECOVERY

 

In the event of a breakdown or an accident, the hirer/driver must notify Gigwheels Ltd immediately.

The hirer must also notify Gigwheels Ltd of any fault lights activating on the dash board or indications that the vehicle is not behaving as expected at the earliest possible opportunity.

 

The hirer must not affect any repairs to the vehicle themselves without consent from Gigwheels Ltd.

 

In the UK, the vehicles are covered by RAC and AA policies and breakdown policy information and phone numbers will be included in the driver's pack given at the commencement of the hire. This breakdown cover includes clauses that guarantee your party and equipment will be taken to their current destination and the vehicle is taken to a garage for repair if the problem cannot be fixed at the roadside. Gigwheels Ltd will either get the vehicle repaired or a replacement vehicle sent as soon as possible [usually within 24 hours].

 

For any vehicles that breakdown in Europe, Gigwheels Ltd will not to be able to supply a replacement vehicle, but will endeavour to get the vehicle repaired in whichever country the breakdown occurred and pay for a replacement hire vehicle of a similar specification.

 

Gigwheels Ltd, whilst taking all precautions and using its best efforts to prevent such happening, shall not be liable for any financial losses or damages arising from any fault or defect that causes the failure of the vehicle. The vehicles are regularly serviced and constantly maintained, but Gigwheels Ltd will not accept liability for any losses suffered by the hirer as a result of breakdown other than those of the hire of the vehicle.

 

FUEL POLICY

 

The hirer will return the vehicle with the same quantity of fuel as was in it at the start of the hire [usually 1/4 tank] . Any shortage on fuel will result in a £25 administration cost plus £2 per litre to refuel the vehicle to the original level

 

DAMAGE TO VEHICLES

 

Gigwheels Ltd and the hirer will together check the condition and contents of the vehicle at the start of the hire period. Gigwheels Ltd will photograph and note any existing damage to the vehicle and the fuel level and mileage. The hirer should be in agreement with the notes made at this time, as any other damage noted on return of the vehicle at the end of the hire will be deemed to be the responsibility of the hirer.

 

The hirer will be responsible for the full cost of repairing any damage resulting from negligence [which will be established by an independent source if required]. In such cases the hirer will be responsible for paying for any loss of earnings caused to Gigwheels Ltd during the repair time and also for any other storage/transportation costs incurred to Gigwheels Ltd as a result of the damage.

 

The hirer is 100% liable for costs incurred because of snapped or lost keys.

 

Gigwheels Ltd will use the £300 or £500 damage deposit to pay for any damage to the vehicle or administration costs incurred to Gigwheels Ltd.as a result of the hire without consultation with the hirer.

 

Gigwheels Ltd will ensure that the correct levels of oil and water are in the vehicle prior to the start of the hire The hirer is responsible for maintaining the correct levels of oil and water during the hire period. Damage caused by lack of oil or water in the engine will be the hirer's responsibility. The hirer is also responsible for any wheel or tyre damage caused during the hire period.

 

The hirer is responsible for the entertainment systems in the vehicle. If any of the entertainment systems are lost, stolen or damaged during the hire, the hirer must pay for replacements and for any repairs required.

 

Refunds will not be issued for any failures in the audio/visual/internet or bluetooth systems.

 

A £40 fee will be charged for cleaning if the vehicle is not returned in a similar state to that it was in when the hire commenced.
